Our pricing policy is to offer our products at the same price to all customers, wherever they live. The tax rules are such that we have to pay VAT on all purchases made within the EC (except for certain tax free areas e.g. Jersey, Andorra etc. So to areas where tax applies, we charge the price displayed and pay the relevant tax to the UK government. Where VAT does not apply we still charge the displayed amount. We have taken this decision to encourage European e-commerce and to make sure that the additional costs in trading with non-European community countries are covered. Unfortunately, as a result of this policy, we are not able to refund VAT charged for any of the tax free areas within the EC as we do not charge VAT to these areas. But you will not be charged any more than any other customer.
Before you return anything to us, for ANY reason, please contact us at firstname.lastname@example.org. We will deal with your query quickly, but we DO need to know about the problem first. Tom McRae Trading will only refund the cost of you posting returns back to us if we've agreed to this before you send them. You should include a note of your name, paypal transaction number and a brief explanation of your reason for returning the items. Also - if you are a UK customer - you should ask the Post Office for a 'proof of postage receipt'. This just proves that you sent the package to us, in case it is lost on its way back to us. The Post Office will not charge you for this. Again, please contact us before sending anything back to us, regardless of where you are in the world.
If you are not satisfied with any of the items you have received because they are damaged, we will either refund you in full (including the postage and packing you were charged), or send you a replacement, if they are available and you request them. We must receive the item(s) back from you within 28 days of delivery and in the same condition that you received them. We must also receive the items back before we send replacements to you, if that's what you've requested.
If items are not delivered due to a mistake on our part you will be completely refunded, or sent the package again without extra charge; whichever you prefer. Please note we can not be responsible if you do not supply the correct postal address. If you get your address wrong and do not notify us before the order is sent, we cannot refund the postage costs. If we accidentally send you items that you did not order, we will refund you for them and also for the cost of the outgoing postage and packing on those individual items, once you send them back to us. If we forget to send you part of your order, we will send it to you free of charge.
If items are not delivered because you gave us incorrect information, or because your post office was unable to deliver the package because there was no-one to receive it and/or no-one came to collect it from the sorting office, you will be refunded for the cost of the items, but not for the postage and packing. We can re-send the items but you will have to pay the P&P charge again.. If you get your address wrong and do not notify us before the order is sent, we cannot refund the postage costs.
If you are not satisfied with any of the items you have received for any other reason (such as simply not liking the music), we will refund you in full for the cost of the items (but not the postage and packing) if we receive the returned items to us in the condition that they were sent, within 28 days of delivery to you. Your statutory rights are not affected either by ordering from us or by us refunding you.
Right to Withdraw Items
We reserve the right to withdraw any items from our web shops at any time.
We will not be liable to you or anyone else for withdrawing any items from our web shop, or refusing to process an order.
Our liability in contract, tort, and negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms & Conditions of Trade shall be limited in aggregate to all sums paid by you to us.
